Pinball Asylum had their name stolen?

What's up with this?  Post on their webpage --

Said somebody stole their name out from under them? I got approved to go there and was lookjng forward to it next time we;re down that way. What's happening to them?

I just heard that too. They aren’t closing, but yes, someone registered/trademarked the name

Anecdote FWIW, not legal advice:

This happened to us a few years back with a WWII-based video game that we released and maintained for 6 years, but never trademarked the name. It was one of those "we'll trademark it when we start making real money" things. Well another indy game studio trademarked the name from under us to produce their own WWII-based video game.  From multiple attorneys, we learned that since the USPTO contestation period of the trademark had passed, there was little recourse to regain the name without what would have been a costly legal fight that would have exceeded the revenue from the game (and then some).

For what it was worth, which wasn't much, we were still entitled to keep the domain name as it was purchased in "good faith" and in-use prior to the trademark and re-point it to our new name.

Here's an idea: Maybe just qualify the Asylum's name a little bit, to differentiate it, then just trademark that. For example, just trademark "PinAsylum", which would be fundamentally different from "The Pinball Asylum".

Appears to have been done the Friday of the weekend that Dan said he was disassociating himself with the Asylum after completion of the Points Monsters Champioship.

May have been some bad blood with the direction the Asylum was moving or a personal issue with another Asylum director.

Hopefully cooler heads will prevail.  A move like this has the potential of boomeranging and having a negative effect on Project Pinball's donations. 

Regardless of the legalities, a name is just a name and the Asylum will continue to flourish.
